Most donated organs in the United States come from brain dead donors, while a small percentage come from patients who die in “controlled,” or expected, circumstances, typically after the family or surrogate makes a decision to withdraw life support. The number of organs available for transplant could be substantially if donations were permitted in “uncontrolled” circumstances–that is, from people who die unexpectedly, often outside the hospital. According to projections from the Institute of Medicine, establishing programs permitting “uncontrolled donation (...) class='Hi'>after circulatory determination of death,” or uDCDD, throughout the United States has the potential to provide 22,000 more donation opportunities annually. In contrast, U.S. controlled donation after circulatory determination of death, or cDCDD, cases have increased progressively over the past decade from 87 to 848 donors, but currently account for only 10.6 percent of all deceased donors. Following the IOM recommendations, several projects exploring the feasibility of uDCDD were funded by the federal government, including a grant from the Health Resources and Services Administration that supported a pilot project in New York City in which the authors of this article participated.A key feature of our protocol, and indeed of many uDCDD protocols, is the initiation of preservation methods such as chest compressions and extracorporeal membrane oxygenation shortly after death in order to perfuse and preserve the donor's organs. Critics of uDCDD argue that the means of determining death deviates from generally ascribed principles. They assert that reinstituting circulation in order to preserve organs has the effect of “undoing” the prior determination of death. The result is that cDCDD is widely accepted and practiced routinely even though it only marginally increases the number of organs available for transplantation, and uDCDD is widely considered unacceptable despite being ethically embraced and proven to significantly increase organ donation opportunities in other countries. This article explores the evolution of this counterintuitive state of affairs and calls for a policy that, in line with the IOM report, allows for both cDCDD and uDCDD protocols. (shrink)

Observers of German-Jewish political theorist Hannah Arendt often disagree on her politics, yet many view her as a staunch early critic of Zionism. Whereas her criticism of Israel rendered her unpopular in the American-Jewish and Israeli communities for many decades after 1948, commentators more recently have come to see her perspective as a prescient assessment of the ills of Jewish nationalism. This interpretation, however, fails to grasp the complexity of Arendt‘s political views of Zionism in particular and of (...) In lieu of an abstract, here is a brief excerpt of the content:A Decade of Teaching Classics in a Massachusetts Prison CHARLES ROWAN BEYE From 1972 until 1982, I volunteered as a teacher in a degree-granting program of liberal arts at the college level in Norfolk State Prison, a medium security prison in Walpole, Massachusetts. Medium security means that the men were not confined to their cells except when there were routine security checks, such as taking attendance which occurred several (...) times a day, or at night when there was a lights-out policy, or whenever the surveillance system of the prison went on alarm. Other than that, the men could work in various shops, or in the prison garden, or, among other things, they could take classes. The men who were incarcerated at Norfolk had been determined not to pose too great a threat to the other inmates, nor to be liable to try to break out in escape attempts that would damage others; the more intractable men were in the maximum security prison down the road, confined to their cells. There had always been shop classes or other kinds of instruction which would train the men into skilled manual labor. I taught in a program that was radically different. It was the dream of an extraordinary woman named Elizabeth Barker who was an old fashioned lefty, a woman of the old money Brahmin class of Boston society, who like so many of her kind had no money any longer, the only indication of her social status being a marbles-in-the-mouth accent, an indifference to money, clothing styles, social distinction, and an arrogance that made her assume that the rest of the world hung on her every word. She was the soul of kindness and generosity, one of the few persons I have met who deserved the accolade of a “true Christian,” although she was insisarion 26.3 winter 2019 tent upon proclaiming her militant atheism. She was also a tremendous bore. I once had the misfortune to drive her back from the prison to Boston. Talking incessantly, in a kind of monotone, relentlessly insisting upon a position that I had agreed with when we started the drive, it was all I could do after a half hour to keep from reaching over, opening the door, and pushing her out. But, God love her, she performed a miracle at Norfolk. Mrs. Barker subscribed to a belief that I soon adopted once I started teaching in her program which was that all people, apart from outright psychopaths, are redeemable, that a teaching relationship offers compassion, instruction, and most of all, a belief in the student, that in itself redeems the student, in this case, the prisoner, from self-hatred, lack of esteem or purpose, and general despair. Conventionally, prisons are run on a mixture of punishment and rehabilitation. At the crudest level you have the concept of solitary confinement, then there is the idea of “at hard labor” where prisoners spend their days breaking rocks under supervision, or as in England at the turn of the century, spending the entire day walking endlessly up a revolving drum with stairs. The lightest so-called punishment is simply the fact of incarceration. The theory is that if you are confined to a prison for so many months, years, the horror of this endurance makes you into a better person because you have had time to realize that you don’t want this to happen again. Relatives of a criminal’s victims are often on hand at parole board hearings because they want the sentence to go on longer, for the prisoner to “suffer more.” Rehabilitation, on the other hand, usually involves teaching skills, on the most basic level, reading and writing, then woodworking, metal work, car repair, on the theory that many males commit crimes because they have no legitimate way to earn money in our economy. Mrs. Barker saw a higher kind of rehabilitation that led into her notion of redemption. The liberal arts, art, music, literature, philosophy, science were in her mind the nourishment of the soul without which no one can truly be said to live. Moltmann’s Theology of Hope still resonates in theological discourses 60 years after the publication of his epoch-making book containing this concept. At a time of fading hope among South Africans, a revisitation of Moltmann’s pattern of reasoning holds the promise of reward. This article focuses on the quest for raising tangible hope in South Africa and the possible contribution of the Theology of Hope in this regard. The central theoretical argument here will be that the failure of hope in (...) South Africa is caused by the fact that hope continues to be viewed in terms of the event of liberation (1994), and not in terms of a liberating process as the Theology of Hope proposes. To unpack this hypothesis and provide preliminary responses to the matters raised here and others, the study revisits Moltmann’s Theology of Hope as centred on the recurrent interpretations and applications that it has received in political theologies. The aim is to translate the core idea of the Theology of Hope into tangible hope for desponding South Africans today. Contribution: This research proposes that hope founded in the sign of the reign of the moving God, such as instances of love, goodness, truth-telling, fair jurisprudence and caring for the poor, which are discernible in South Africa today, are valuable and plausible building blocks for the creation of continuous tangible hope. The hope that rests in the actions of the moving God is of greater value than that residing in a single historic event. The 1994 liberation event, lauded by many as the great cause of perennial hope, has faded away in recent years and turned into a pervasive despondency within the South African community. (shrink)

This paper identifies ‘savage numbers’ – number-like or number-replacing concepts and practices attributed to peoples viewed as civilizationally inferior – as a crucial and hitherto unrecognized body of evidence in the first two decades of the Victorian science of prehistory. It traces the changing and often ambivalent status of savage numbers in the period after the 1858–1859 ‘time revolution’ in the human sciences by following successive reappropriations of an iconic 1853 story from Francis Galton's African travels. In response (...) to a fundamental lack of physical evidence concerning prehistoric men, savage numbers offered a readily available body of data that helped scholars envisage great extremes of civilizational lowliness in a way that was at once analysable and comparable, and anecdotes like Galton's made those data vivid and compelling. Moreover, they provided a simple and direct means of conceiving of the progressive scale of civilizational development, uniting societies and races past and present, at the heart of Victorian scientific racism. ABSTRACT:Daniel Callahan died on July 16, 2019, just short of his 89th birthday. In the years since, we have seen the overturning of abortion rights, a concern central to his scholarship and musings about the place of religion in American civic life. Callahan’s journey from lay Catholic journalist and commentator at Commonweal to a co-founder of the Hastings Center, during his decade of doubt, is especially relevant today as America revisits established precedent governing a woman’s right to choose. His life-long (...) struggle with faith and the secularization of bioethics is a story worth telling, as it may foster dialogue across a divide between religious and laical thinkers that has fractured our political discourse. We recall Callahan’s misgivings about the marginalization of religious perspectives in public life; he sought not the denial of complexity nor of difference in views, but rather the importance of free and honest debate around deeply held beliefs, contextualized in the realities of the contemporary world. Callahan’s ambivalence about his faith remains a part of the fabric of American life, a story that Callahan chronicled to our collective benefit for over a half-century. (shrink)

Most of our knowledge about the life of Matthew of Vendôme derives from autobiographical passages in his writings. The date of his birth is uncertain, but it is known that after the death of his father he went to Tours, some twenty-five miles from his birthplace, where he was raised by his uncle and studied composition under Bernardus Silvestris. Matthew continued his studies at Orléans during the residence of Hugh Primas in that city, and eventually achieved a position of (...) some prominence as a teacher of grammar in the cathedral school. It was toward the close of his stay here that, sometime before 1175, he composed the Ars versificatoria as a textbook for beginning students. But Matthew's peace at Orléans had been shattered by the arrival of Arnulf of Saint-Euverte, best known as a scholiast on Lucan and Ovid, with whom he entered into a bitter rivalry; the Ars is filled with invective against Arnulf under the nicknames Rufus and Rufinus. Around 1175, Matthew left Orléans and proceeded to Paris, where he seems to have resumed his studies. He remained there for ten years, and in the course of this decade wrote the Epistolarium, a collection of letters in verse. He then returned to Tours, where he was perhaps granted a canonry at the cathedral of St. Martin, and where he completed the Tobias, a versification of the book of Tobit which he dedicated to Bishop Bartholomew of Tours and to the prelate's brother, the dean of St. Martin. It is presumed that he died shortly after its composition. (shrink)

This article focuses on the long-term impacts and effects of developmental work that began as an arts education project in Helsinki in 2000. Ten years later, five kindergarten leaders were interviewed to gather information about the impacts of the project. The aim was to determine the long-term effects of the project and examine in which ways the impact could still be seen in the daily work in kindergartens. We also explored the reasons and prerequisites for the impacts still showing, and (...) tried to discover which obstacles prevent the ongoing impact of the developmental work. The interviews showed that the sustainability of the impacts was connected to the organizational changes and the longevity of the personnel in the kindergarten. The developmental work could be better taken advantage of when the kindergarten leaders felt the tasks developed in the project were important and offered them new ideas in their pedagogical leadership. A long-lasting developmental project was seen as part of the process of updating education, which confirmed the participants’ consciousness about being a teacher and the nature of the educational practices as well as a reflective manner of working. Participating also increased general developmental skills and interest in other developmental themes. (shrink)

Freedom of speech has been essential in building democracy in Lithuania after regaining its independence. Exercise of the constitutional freedom of expression within the societies following constitutional values is the major factor shaping the political will of citizens. Wide-ranging, all round public discussion about all public interest issues is possible only when it is subject to due freedom of information. In indirect democracy, strong disseminator of information acting between citizens and the Parliament able to create the field for discussion (...) and mutual impact is a necessity. Significance, quality, all-roundedness of discussion on all public interest issues is the major factor determining correct choices of citizens and politicians. Restriction of freedom of expression and information or prohibition of free search, receipt and dissemination thereof shall be considered as subjugation of a human being as a free and autonomous creature. Freedom of speech is a highly important feature in building democracy. The media in Lithuania during two decades of democracy building has actively made the use of freedom of self-expression. The courts have solved a lot of case-laws, where freedom of speech, honour, dignity and private life were at stake. The Parliament, the Constitutional Court, the European Court of Human Rights in Strasburg, the Government, the Inspector of Journalist Ethics and the Commission on Journalists and Publishers Ethics, the courts of Lithuania – all institutions took part in the process of defining freedom of speech and its limits in Lithuania during two decades of its independence. The purpose of this publication is to identify if the case-law of Lithuania’s courts in balancing the contradictions between the freedom of self-expression and personal dignity, honour and private life is in line with the Convention for the Protection of Human Rights and Fundamental Freedoms, jurisprudence of the Human Rights Court in Strasbourg. Defining if the case-law of Lithuania’s courts are in line with the jurisprudence of the Human Rights Court in Strasbourg, the research is concentrated on legal tests applied in the case-law of freedom of speech – distinguishing between public and private figures, estimating disseminated information as facts or value-judgments, freedom of speech decriminalization problems, compensation in respect of pecuniary damage. The critical problems of the Third Decade of Livy have long been familiar to students. In Books XXI.–XXV. we have only the mutilated Codex Puteanus of the fifth century and later manuscripts derived from it, directly or indirectly, at one or more points in its history. R, C, and most probably M, are copies of P, after it was corrected by P2 and probably P3. Here the problem in the parts in which P is preserved is to correct its (...) numerous corruptions by conjecture as far as possible; and, where it is now defective, by comparing the later MSS. to arrive at their inter-relation and at P's original text, and then subject this text to the same process of criticism. Also a study of the corrections in the earlier of these MSS. may reveal the previous existence of other traditions and of other MSS. now lost—such corrections, e.g., as are made by P4, R2, and M2. The Right has a long history of questioning the importance of race analysis. Recently, the conceptual and political status of race has come under increased scrutiny from the Left. Bracketing the language of ‘race’ has meant that the discourse of skin groups remains at the level of abstraction and does not speak to real groups as such. As a descriptor, race essentializes identity as if skin color were a reliable way to perceive one's self and group as well as others, (...) and questions the viability of a social struggle based on race. In other words, race is not real and discourses that insist on its objective status are ensnared in reification. The response—equally from the Left—has been to reassert the centrality and changing dynamics of race in education and society. They argue that we need to develop more, rather than less, complex discourses on race. Orientations that attempt to discredit race analysis are therefore unable to dismantle the racial system because they refuse its significance as an autonomous system of interpellations. In other words, race is real. This essay appraises the debate within the Left about the status of race, their projections about the future of race, and the kind of struggle they promote in order to realize a society freed from the chains of racism. Nursing Inquiry 2010; 17: 186–196Ambivalence and the experience of China-educated nurses working in AustraliaThe last decade has seen an increase in research on the experience of immigrant nurses. There are two prevailing approaches in this body of work. One is a focus on the positive or negative aspects of the experience, and the other, a depiction of the experience as a linear movement from struggle to a comfortable state. Based on our (...) study findings on the experience of China-educated nurses working in Australia, this study proposes that the concept of ambivalence is more appropriate in portraying the experience of immigrant nurses. Several sources of ambivalence experienced by the participants are represented: a disparity between expectation and reality, conflicting social and cultural norms, the dual reference points of comparison, divergent interests within families, and a sense that although it is unsatisfactory, it is hard to go back. We argue that immigration generates various forms of ambivalence and immigrant nurses must live with more or less ambivalence. The notion of ambivalence can explain a range of behaviours and situations beyond the scope of rational-choice explanations. To date, ambivalence as a theoretical concept in understanding the experience of immigrant nurses has been either ignored or insufficiently addressed in the literature. (shrink)

The fragile national consensus on civil rights policy has been increasingly fragmented by resistance and confusion in recent years, especially under the impact of the Reagan administration's efforts to change its direction dramatically. Similarly, since the mid-1960s, the women's rights movement has worked to end discrimination and bring about greater equality for (...) women in employment and public life. This seemingly strange confluence of cultural tendencies does, (...) however, help explain why studying the drawn-out debates among German neohumanist scholars on the cultural origins of the Greeks ultimately offers a fresh perspective on certain problems of German national identity—in this case, on the ambivalent relationship to things foreign in that period of German history.Scholarly attention has recently been drawn to this question as part of the conflict over Martin Bernal's Black Athena, the first volume of which argued that nineteenth-century German classicists' denial of an Egyptian contribution to early Greek cultural development revealed their xenophobic tendencies. While Bernal pointed to racism as the prime motive for this repudiation of African and later of Semitic influence on the Greeks, he also invoked several of the other "-isms" that have proven so fruitful yet confusing for efforts to understand the intellectual and cultural climate of late eighteenth and early nineteenth-century Germany: romanticism, historicism, organicism, and of course neohumanism. 1 [End Page 483]The present essay is not intended to be another of the past decade's many responses to Bernal. Attention must be paid to that discussion, but it is important to recognize the extent to which this debate reflects a much broader disagreement about German attitudes in the romantic and nationalist eras. Some scholars portray the more cosmopolitan side of the romantic inheritance and stress its continued fascination with foreign literatures and cultures. Others, however, seem more like Bernal in citing the historicist turn to nature and nationality either to illustrate or to explain an alleged German xenophobia and hypersensitivity to issues of ethnic and cultural purity. 2It is to this wider question of the cultural legacy of German classicism and romanticism, historicism and organicism, that I would like to direct attention in this essay. Rather than invoking these "-isms" in an effort to explain the various positions taken in the debate about Greek origins, I hope to reverse the process and examine the relevant texts in an effort to clarify the broader implications of these issues of cultural purity and cultural borrowing, from the time of Winckelmann's first assertion of Greek originality through the rise of new kinds of nationalism and racism in the Wilhelmine era. 3 I shall show that belief in the importance of Greek civilization's Asian and even Egyptian cultural heritage remained strong for decades, even after Karl Otfried Müller's seemingly definitive rejection of such a connection in the 1820s. Moreover, most of the figures engaged on both sides of the debate made remarkably similar use of historicizing organic metaphors to help reconcile the twin values of national autonomy and cultural transmission, both so central to the self-conception and national identity of the German Bildungsbürgertum in this period. Continuity and connection with the environment, not purity and isolation from it, were the hallmarks of such organicist thinking across a wide spectrum of romantic, neohumanist, and idealist commentators. Only in the second half of the nineteenth century, with the passing of romantic values, the transformation of historicism into historicist positivism, and the development of new meanings attached to images of biology and race, would this situation slowly begin to change. ABSTRACT This paper aims to offer both an interpretation and a critique of the epistemological foundations underlying one of the most recent approaches to trauma studies: cultural trauma theory. After the First World War, the founding father of psychoanalysis, Sigmund Freud, inquired into whether his diagnostic of “traumatic neurosis” could shed light on how collectives deal with unsettling experiences and memories. Throughout the intervening decades, Freud´s insights into collective trauma have attracted the interest of scholars from various disciplines (...) within the humanities and social sciences, from literary studies to historiography, memory studies, and, finally – the focus of this paper – cultural and social theory. By underlining the ways in which the proponents of cultural trauma theory – Jeffrey Alexander, Neil Smelzer, Piotr Sztompka, Bernhard Giesen, and Ron Eyerman – have reframed Freudian ideas regarding the transmission of legacies of collective suffering, the paper considers whether the notion of trauma can be extended to the analysis of cultures and societies. It explores the ambivalent relationship between psychoanalysis and contemporary cultural trauma theory to disclose the theoretical assumptions and weaknesses of the latter. (shrink)

After two years of global pandemic, it is no surprise that immunization is now at the center of our experience. From the medicalization of politics to the disciplining of individuals, from lockdowns to mass vaccination programs, contemporary societies seem to be firmly embedded in a syndrome of immunity. To understand the ambivalent effects of this development, it is necessary to go back to its modern genesis, when the languages of law, politics, and medicine began to merge into the biopolitical (...) regime we have been living under for some time. This regime places a high priority on immunization and security: no security is more important than health security. The Covid-19 pandemic has taken the dynamic of immunization to a new level: for the first time in history, we see societies seeking to achieve generalized immunity in their entire populations through vaccination. This allows us to glimpse the possibility of a “common immunity” that strengthens the relation between community and immunity. The dramatic tensions we have experienced in recent years between security and freedom, norm and exception, power and existence, all refer to the complex relationship between community and immunity, the decisive features of which are reconstructed in this book. Building on the prescient argument originally developed two decades ago in Immunitas, Roberto Esposito demonstrates in this new book how the pandemic and our responses to it have brought into sharp relief the fundamental biopolitical conditions of our contemporary societies. This paper investigates whether philosophers ever regarded the teaching of philosophy as a central concern by considering the first decades of professional associations that ultimately merged into the American Philosophical Association (APA). Before the APA, philosophical education was mostly devoted to the development of the Christian gentleman. Upon its founding, the APA’s first president (James Edwin Creighton) took the central functions of the APA to promote original investigation, publication, and collaboration, rather than teaching. Despite Creighton’s position that teaching should (...) not play a role in the APA, an investigation of the early years of the APA show that philosophers had some, albeit infrequent, interest in pedagogical issues related to philosophy. Thus, it is argued that the early years of the APA reflect a deep ambivalence toward teaching. (shrink)

Over a decade ago, Arthur Danto announced that art ended in the sixties. Ever since this declaration, he has been at the forefront of a radical critique of the nature of art in our time. McNair (1991) discusses the "proper compromises" made by junior auditors in large public accounting firms by arguing that the conflict between high-quality and low-cost auditing leads to "ethically ambivalent" behavior. Specifically, McNair provides evidence that success during the early stages of a public accounting career requires auditors to complete quality audits in an unreasonably short period of time. Completing quality audits within insufficient time constraints puts junior auditors in the following dilemma: report time truthfully and fail versus underreport time and (...) succeed. We reevaluate this conflict approximately one decade after McNair''s study and provide evidence that pressures toward "ethical ambivalence" have been reduced in public accounting firms. (shrink)

In this chapter, I will address the philosophical ambivalence of the concept of Willkür in and after Kant. The aim of my chapter is to defend it against the charge of irrationality and mere chance, and to rehabilitate it from a historical and analytic point of view. I will analyze Kant’s use of the word “Willkür”, and chronologically follow the semantic and systematic changes in his philosophical work. Finally, I address recent attempts to revitalize the concept of Willkür (...) in the analytic debate by referring to the work of Harry Frankfurt and Robert Kane. I shall argue that we need to distinguish between two kinds of libera arbitria. Whereas the liberum arbitrium indifferentiae can be interpreted in terms of the pejorative sense of “Willkür”—as mere chance—the liberum arbitrium voluntatis equals a reflective kind of Willkür—literal Will-kür —which involves freedom of the will. Textures of the Ordinary shows how anthropology finds a companionship with philosophy in the exploration of everyday life. Based on two decades of ethnographic work among low-income urban families in India, Das shows how the notion of texture aligns ethnography with the anthropological tone in Wittgenstein and Cavell, as well as in literary texts. The book shows different routes of return to the everyday as it is corroded not only by catastrophic events but also by repetitive and routine violence (...) within everyday life itself. As an alternative to normative ethics, this book develops ordinary ethics as attentiveness to the other and as the ability of small acts of care to stand up to horrific violence. Textures of the Ordinary offers a model of thinking in which concepts and experience are shown to be mutually vulnerable. From the first time I encountered the problem of free will in college, it struck me that a clear-eyed view of free will and moral responsibility demanded some form of nihilism. Libertarianism seemed delusional, and compatibilism seemed in bad faith. Hence I threw my lot in with philosophers like Paul d’Holbach, Galen Strawson, and Derk Pereboom who conclude that no one is truly moral responsible. But after two decades of self- identifying as a nihilist, it occurred to me (...) that I had continued to treat my friends. (shrink)

Recent scholarship, focusing on the rapid decline of microscopy after the late 1680's, has shown that the limitations of microscopy and the ambivalent meaning of its findings led to a wide-spread sense of frustration with the new instrument. The present article tries to connect this fall from favor with the microscope's equally surprising but hitherto little noticed late rise to prominence. The crucial point is that when the microscope, more than a decade after the telescope, finally managed to (...) arouse the interest of natural philosophers, it did so as a corpuscularian tool, and as such it came to share the difficult fate of seventeenth-century corpuscularianism. The essay ends with the claim that the fall of microscopy was not only due to the failure of microscopy to corroborate corpuscularianism, but also to the changing definition of natural philosophy in the late seventeenth and early eighteenth centuries and to the separation of the domains of living matter from a physica whose recent mathematical framework excluded the organic world. In the past few decades, ‘postmodern philosophers’ have leveled severe and sustained criticisms against “the Tradition.” They have radically put in question and undermined our traditional conceptions of Philosophy, its tasks and goals, claims and pretensions, methods and methodologies, its public image and selfimage.In short, everything that Philosophers once held dear, and that some still hold dear today, moved as they are by a quest for Certainty and nostalgia for the Absolute. As a result, many have come to view (...) these radical, postmodern criticisms as having brought on the “End of Philosophy.” If this is so, what is to be done? Where do we go from here? What are our real options? What is there left for Philosophers to do, if anything, that is worthwhile and meaningful? Do we simply accept ‘the postmodernists’ verdict,’ and simply take up whatever they have proposed to replace Philosophy? Or do we boldly and imaginatively consider an alternative? In my essay, I sketch out a 10-points proposal for a ‘philosophy’ –after the end of Philosophy—which, I contend, can only be a new kind of CriticalTheory. (shrink)
